1. Agreement to Terms

Welcome to ImageToPass! By accessing or using our Apple Wallet Pass Generator service at imagetopass.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and reHosted ("Company," "we," "us," or "our").

2. Service Description

ImageToPass provides a web-based service that allows you to:

• Create custom Apple Wallet passes (.pkpass files)
• Choose between Standard passes (1 credit) or Hybrid passes (5 credits)
• Standard passes: Download to Apple Wallet only, 48-hour download window
• Hybrid passes: Apple Wallet + online viewing for 1 year with unlimited views
• Purchase credit packs to generate passes
• Upload images and customize pass information
• Receive download links via email for generated passes
• Access your pass history and credit balance through a dashboard

Current Pricing: $5.00 USD per credit pack (20 credits)

3. Account Registration & Authentication

3.1 Magic Link Authentication

ImageToPass uses passwordless authentication via email "magic links." When you sign up or log in, we send a one-time link to your email address. This link expires after 4 hours and can only be used once.

3.2 Account Eligibility

You must:

• Be at least 13 years of age
• Provide a valid email address that you have access to
• Use the Service only for lawful purposes
• Not share your account access with others

3.3 Account Security

You are responsible for maintaining the security of your email account. We are not liable for unauthorized access resulting from compromised email accounts.

4. Credits & Payment Terms

4.1 Credit Packs

4.2 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information. By making a purchase, you agree to Stripe's terms and conditions.

4.3 Credit Usage

• Credits are deducted automatically when you generate a pass
• Standard passes use 1 credit per pass
• Hybrid passes use 5 credits per pass
• Credits are used on a First-In-First-Out (FIFO) basis (oldest credits used first)
• Credits cannot be transferred between accounts
• Credits have no cash value and cannot be exchanged for money

4.4 Pricing Changes

We reserve the right to change our pricing at any time. Changes will not affect credits already purchased. You will be notified of pricing changes via email before they take effect.

5. Refund Policy

We offer refunds on unused credit packs within 30 days of purchase. For complete details, please see our Refund Policy.

5.1 Refund Eligibility

• Refunds are available for completely unused credit packs only
• Requests must be made within 30 days of purchase
• Partial refunds for partially used packs are not available
• Credits used for pass generation are non-refundable

5.2 How to Request a Refund

Email support@imagetopass.com with your account email and purchase details. Refunds are processed within 5-7 business days.

6. Pass Generation & Downloads

6.1 Pass Types

We offer two types of passes:

6.2 Pass Creation

When you create a pass:

• 1 credit (standard) or 5 credits (hybrid) are deducted from your account immediately
• The pass is generated and you receive an email with a download link
• Standard pass images are deleted immediately after pass generation
• Hybrid pass images are stored securely for 1 year for online viewing
• Pass metadata (title, type, creation date) is stored in your account history

6.3 Download Links & Access

It is your responsibility to download standard passes within the 48-hour window. We cannot regenerate expired passes without using additional credits.

6.4 Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We are not liable for temporary unavailability due to maintenance, technical issues, or circumstances beyond our control.

7. Acceptable Use Policy

You agree NOT to use ImageToPass to:

• Create passes containing illegal, harmful, or fraudulent content
• Impersonate any person, organization, or brand without authorization
• Upload images you do not have rights to use
• Create passes that violate intellectual property rights
• Distribute malware, viruses, or malicious code
• Attempt to reverse engineer, hack, or compromise the Service
• Resell or redistribute our Service without permission
• Use automated tools (bots, scrapers) to abuse the Service
• Create passes that contain hate speech, harassment, or discriminatory content
• Generate passes for spam, phishing, or fraudulent purposes

Violation of this policy may result in immediate account termination without refund.

8. Intellectual Property

8.1 Your Content

You retain ownership of all images and text you upload. By using our Service, you grant us a limited license to process your content solely for the purpose of generating passes.

You represent and warrant that you have all necessary rights to the content you upload.

8.2 Our Service

ImageToPass, our logo, design, and all related intellectual property are owned by reHosted. You may not copy, modify, or redistribute any part of our Service without written permission.

8.3 Apple Wallet

"Apple Wallet" and ".pkpass" are trademarks of Apple Inc. ImageToPass is not affiliated with, endorsed by, or sponsored by Apple Inc.

9. Data & Privacy

Our collection, use, and protection of your personal information is governed by our Privacy Policy.

Key privacy highlights:

• We only collect your email address for authentication
• Standard pass images are deleted immediately after pass generation
• Hybrid pass images are stored securely for 1 year for online viewing
• Standard pass files are deleted 48 hours after creation
• Hybrid pass data expires and is deleted after 1 year
• We never sell your data to third parties

You agree to indemnify, defend, and hold harmless reHosted, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights (including intellectual property rights)
• Content you upload or passes you create

13. Termination

13.1 By You

You may terminate your account at any time by contacting support@imagetopass.com. Unused credits in terminated accounts are non-refundable unless eligible under our Refund Policy.

13.2 By Us

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent or illegal activity
• Non-payment or chargebacks
• Abuse of the Service or harassment of our staff

If we terminate your account for cause, no refunds will be issued.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email. The "Last Updated" date at the top indicates the most recent revision.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Dispute Resolution

15.1 Informal Resolution

If you have a dispute, please contact us first at support@imagetopass.com. We will work in good faith to resolve the issue.

15.2 Governing Law & Venue

These Terms are governed by the laws of the State of Colorado and the United States, without regard to conflict of law principles. You agree that any legal action or arbitration must take place in the State of Colorado.

15.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration proceedings must be held in the State of Colorado. You waive the right to participate in class action lawsuits.

15.4 Jurisdiction

If for any reason arbitration does not occur and court proceedings are necessary, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Colorado. You waive any objection to venue in Colorado and any claim that Colorado is an inconvenient forum.

16. Miscellaneous

Severability: If any provision of these Terms is found invalid, the remaining provisions remain in effect.

No Waiver: Our failure to enforce any right does not waive that right.

Assignment: You may not transfer your account. We may transfer our rights and obligations without notice.

Entire Agreement: These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and reHosted.
